A transfer\u00eancia para o regime domiciliar foi fundamentada na incapacidade t\u00e9cnica do <strong>Complexo M\u00e9dico Penal (CMP)<\/strong>, em Pinhais, de oferecer o suporte necess\u00e1rio ao estado de sa\u00fade do detento.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u200bOs fundamentos da decis\u00e3o<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">\u200bO magistrado respons\u00e1vel pelo caso aceitou o argumento da defesa de que a unidade prisional n\u00e3o disp\u00f5e de infraestrutura, equipamentos ou equipe m\u00e9dica suficiente para garantir o tratamento cont\u00ednuo de que Guaranho necessita.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u200b<strong>O argumento central:<\/strong> A dignidade da pessoa humana e o direito \u00e0 sa\u00fade prevaleceram sobre a manuten\u00e7\u00e3o da pris\u00e3o em regime fechado convencional.<\/li>\n\n\n\n<li>\u200b<strong>A condi\u00e7\u00e3o:<\/strong> Jorge Guaranho dever\u00e1 cumprir medidas cautelares rigorosas, incluindo o uso de <strong>tornozeleira eletr\u00f4nica<\/strong> e a proibi\u00e7\u00e3o de contato com testemunhas ou familiares da v\u00edtima.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">\u200bRelembre o caso<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">\u200bO crime aconteceu em julho de 2022, em Foz do Igua\u00e7u, durante a festa de anivers\u00e1rio de 50 anos de Marcelo Arruda, que tinha como tema o Partido dos Trabalhadores.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>\u200b<strong>A Invas\u00e3o:<\/strong> Guaranho, motivado por diverg\u00eancias pol\u00edticas, invadiu a celebra\u00e7\u00e3o.<\/li>\n\n\n\n<li>\u200b<strong>O Confronto:<\/strong> Ap\u00f3s uma discuss\u00e3o inicial, ele retornou ao local e disparou contra Arruda, que reagiu para defender os convidados.<\/li>\n\n\n\n<li>\u200b<strong>O Desfecho:<\/strong> Arruda faleceu no local; Guaranho foi ferido, socorrido e posteriormente condenado pelo Tribunal do J\u00fari.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">\u200bRea\u00e7\u00f5es e pr\u00f3ximos passos<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">\u200bA decis\u00e3o gerou rea\u00e7\u00f5es imediatas. A assist\u00eancia de acusa\u00e7\u00e3o e a fam\u00edlia de Marcelo Arruda expressaram indigna\u00e7\u00e3o, argumentando que a medida gera uma sensa\u00e7\u00e3o de impunidade diante de um crime de tamanha gravidade e motiva\u00e7\u00e3o f\u00fatil.
